These terms and conditions (Terms and Conditions) apply to the enrolment into Chamber of Commerce and Industry of Western Australia Limited (CCIWA)’s training courses (Training Courses) and/or the registration to attend CCIWA events (Events).

You acknowledge that you are fully aware of your rights and obligations under, and agree to be bound by, these Terms and Conditions.

About CCIWA

    1. CCIWA is committed to advancing trade and commerce in Western Australia, driven by our fundamental belief in free enterprise.
    2. Our vision is for Western Australia to be the best place to live and do business. To achieve this, we listen to the needs of all our stakeholders — businesses, families, consumers and the WA workforce – and respond with agenda-setting policy and advocacy work.
    3. CCIWA hosts a number of Events and Training Courses throughout the year which assists us in achieving this vision. Our Events and Training Courses provide, for example, regular updates on the general economy in WA, industry networking opportunities, engagement and education of the WA workforce and endless opportunities for businesses and their stakeholders to add value to their operations.

Training Courses

Training Courses and Training Course Fees

Training Courses will be delivered in the following formats:

    1. Face to Face – the training course takes place in a physical venue and attendees must attend said venue in person to participate; and
    2. On-Line – the training course takes place “live” via an online delivery – participation is undertaken by joining the training course online via a link provided by CCIWA.

Training Courses conducted by way of eLearning Subscriptions are governed by the eLearning Terms and Conditions.

You agree to pay the fees for the Training Course (Training Course Fees) as detailed on the CCIWA website or as determined by CCIWA from time to time. Training Course Fees are set out separately for:

    1. CCIWA members; and
    2. non-members.
      If you wish to be eligible for CCIWA member Training Course Fees you should complete a Membership Application Form that can be found on our website.

The Training Course Fees are GST inclusive.

You must pay:

    1. the Training Course Fees immediately at the time of enrolling through CCIWA’s website (or any other on-line platform); or
    2. subject to agreement by CCIWA, the tax invoice for the Training Course Fees within thirty (30) days of receipt.

Enrolment changes

If you are unable to attend the Training Course on the date you have enrolled for (Course Date), you may: (A) cancel; (B) transfer; or (C) substitute, your Training Course.

Any request to cancel, transfer or substitute a Training Course must be made in writing via email to [email protected].

If you do not:

    1. provide us with the required written notice within the required time periods (as set out in these Terms and Conditions);
    2. attend the Training Course; or
    3. complete the Training Course in its entirety,
      no refunds are payable and no changes/variations to your enrolment will be accepted.

CCIWA (in its absolute discretion) reserves the right to review this policy in the case of special circumstances where sufficient evidence is provided.

Cancellation

If your request to cancel your enrolment in the Training Course (Cancel Request) is received ten (10) business days or more before the Course Date, CCIWA will refund the Training Course Fees.

No Cancel Requests will be accepted less than ten (10) business days before the Course Date and you will forfeit 100% of the Training Course Fees.

Transfer

Subject to the conditions below, you may request a transfer of your enrolment to a different: (A) training course date; (B) training course altogether; or (C) training course format (Transfer Request).

Only one (1) Transfer Request is permitted per enrolment and the alternative option must be within twelve (12) months of the original Course Date.

If your Transfer Request is received ten (10) business days or more before the Course Date, CCIWA will accept the Transfer Request.

No Transfer Requests will be accepted less than ten (10) business days before the Course Date. If you do not attend the Training Course, you will forfeit 100% of the Training Course Fees.

At all times, a Transfer Request is subject to availability of the alternative training course date, training course or training course format as set out in your Transfer Request.

There will be no refund by CCIWA of any funds if the Training Course Fees paid for the original Training Course are less than the fees applicable to the alternative Training Course.

If a further/second Transfer Request is received, it will be treated as a cancellation and you will forfeit 100% of the Training Course Fees.

Substitution

Subject to the conditions below, you may request to substitute another person to enrol in the Training Course (Substitution Request).

If your Substitution Request is received ten (10) business days or more before the Course Date, CCIWA will accept the Substitution Request.

No Substitution Requests will be accepted less than ten (10) business days before the Course Date. If you do not attend the Training Course, you will forfeit 100% of the Training Course Fees.

Only one (1) substitution is permitted per enrolment.

If the substitution involves a participant change from a CCIWA member to a non-member, any difference in the Training Course Fees will be payable by you. There will be no refund by CCIWA of funds if the participant change is from a non-member to a CCIWA member.

If a further/second Substitution Request is received, it will be treated as a cancellation and you will forfeit 100% of the Training Course Fees.

Events

Events and Event Fees

Events will be delivered in the following formats:

    1. Face to Face – the event takes place in a physical venue and attendees must attend said venue in person to participate;
    2. On-Line – the event takes place “live” via an online delivery – participation is undertaken by joining the training course online via a link provided by CCIWA; and
    3. Hybrid – the event may be offered for both Face to Face and On-Line attendance.

You agree to pay the fees for the Event (Event Fees) as detailed on the CCIWA website or as determined by CCIWA from time to time. Event Fees are set out separately for:

    1. CCIWA members; and
    2. non-members.
      If you wish to be eligible for CCIWA member Event Fees you should complete a Membership Application Form that can be found on our website.

The Event Fees are GST inclusive.

You must pay:

    1. the Event Fees immediately at the time of enrolling through CCIWA’s website (or other on-line platform as applicable); or
    2. subject to agreement by CCIWA, the tax invoice for the Event Fees within thirty (30) days of receipt.

Registration changes

If you are unable to attend the Event for which you have registered, you may: (A) cancel; or (B) substitute, your registration.

Any request to cancel or substitute an Event must be made in writing via email to [email protected].

Please note that a charge may apply (see below). We deduct any applicable charge from any refund due to you.

If you do not:

    1. provide us with the required written notice within the required time periods (as set out in these Terms and Conditions); or
    2. attend the Event,
      no refunds are payable and no changes/variations to your registration will be accepted.

CCIWA (in its absolute discretion) reserves the right to review this policy in the case of special circumstances where sufficient evidence is provided.

Cancellation

If your request to cancel your registration to the Event (Cancel Request) is received ten (10) business days or more before the proposed date of the Event (Event Date), CCIWA will refund the Event Fees (less any applicable administrative charges)..

No Cancel Requests will be accepted less than ten (10) business days before the Event Date and you will forfeit 100% of the Event Fees.

Substitution

You may request to substitute another person to attend the Event in your place at any time prior to the Event Date.

For the avoidance of any doubt, there will be no refund by CCIWA of Event Fees if the participant change is from a non-member to a CCIWA member.

Cancellation of Training Courses and Events by CCIWA

CCIWA reserves the right to cancel or vary Training Courses and/or Events without notice and for any reason whatsoever.

If CCIWA cancels or varies dates or locations due for any reason (including insufficient training course enrolments and/or event registrations) you will be offered a full refund of the Training Course Fees and/or Event Fees, or a transfer (Training Courses only) or substitution (which will not be treated as a request by you for the limits specified above).

CCIWA will not be liable for any direct or indirect costs, losses, claims or liability arising from cancellation of any Training Courses or Events. We strongly encourage you to take this into consideration when booking travel arrangements.

Dietary Requirements

You must provide relevant dietary requirements to CCIWA no less than five (5) business days before the Training Course Date and/or Event Date and CCIWA will use its best endeavours to fulfil your request.

Regardless of the above, you agree and acknowledge that CCIWA cannot guarantee your special dietary requirements can, or will be, catered for.

You release CCIWA from any and all liability and responsibility in respect to the provision of catering at the Training Course and/or Event in accordance with your special dietary requirements.

Code of Conduct

You must agree to observe the following minimum standards of conduct at all Training Courses and Events (including those conducted by way of an on-line and/or virtual format):

    1. Showing courtesy and respect to other attendees, whether they are CCIWA members, guests or employees of CCIWA, or employees of an event venue.
    2. Not engaging in conduct which may be reasonably be perceived as harassing, intimidating, overbearing or physically or emotionally threatening.
    3. At all times, adhering to the event venue guidelines and regulations, including, not limited to, the wearing of name badges for certain official parliamentary events, and the applicable dress code, etc

CCIWA reserves the right to remove from a venue any person who does not meet the standards set out above and to take any other action available to it under its Constitution or By-Laws in relation to the CCIWA membership of an attendee who does not meet these standards.

If you do not observe the minimum standards of conduct and your behaviour (directly or indirectly) results in damage (of any extent) to the venue, you release CCIWA from any and all liability, and agree that you will be liable, for any costs or fees incurred in the reparation of the venue.

Responsible Service of Alcohol

CCIWA meets its obligations under relevant Responsible Service of Alcohol laws in relation to all Training Courses and Events.

CCIWA requires organisations that provide hospitality services in relation to Training Courses and Events to comply with all relevant laws relating to Responsible Service of Alcohol.

CCIWA reserves the right to remove from a venue any person who is noticeably intoxicated in accordance with its obligations under Responsible Service of Alcohol laws.

Third Party Views

You acknowledge that CCIWA may engage third parties to be keynote speakers at certain Events.

You agree and acknowledge that the views, thoughts, and opinions expressed by that third party belong solely to that third party in their personal capacity and do not necessarily represent the views, thoughts, and opinions of CCIWA.

You release CCIWA from any and all liability in respect to the views, thoughts, and opinions expressed by a third party during an Event.

Information Technology and Communications

CCIWA confirms it will take all reasonable steps to utilise quality information technology and communication services and processes, including provision of identified mitigants in the event of an error, for example the provision of alternate internet service for facilitators in the event of poor internet coverage.

Notwithstanding this, the CCIWA does not guarantee that online facilitation will be performed error-free or uninterrupted, or that CCIWA will correct all online facilitation errors.

You acknowledge that CCIWA does not control the transfer of data over communications facilities, including the internet, and that the online facilitation may be subject to limitations, delays, and other problems inherent in the use of such communications facilities.

CCIWA is not responsible for any delays, delivery failures, recording failures or other damage resulting from such problems.

To the extent not prohibited by law, there are no express or implied warranties or conditions including for systems, networks or environments or satisfactory quality.

On-Line recording notice

By registering for an on-line Training Course or Event, you acknowledge that you may be photographed, filmed or recorded including audio-visual content recordings utilising event management platforms and video communications providers, such as Zoom while at the Training Course and/or Event, and consent to such activities and the future use by the CCIWA of any photographs, images or recordings.

You may request to opt out of this photography, filming or recordings, however we may not be able to accommodate your request in some instances as we may not be able to provide to you, some or all of our Training Courses and/or Events products and services. You may also find that you do not experience the full extent of our Training Course and/or Event information and products and services.

If you do not consent to the recording, please contact CCIWA via email to [email protected] (for Training Courses) or [email protected] (for Events) a minimum of seven (7) business days prior to the Training Course Date and/or Event Date to discuss your concerns.

Use of material

Materials and content made available to you as a course participant are subject to copyright and other rights owned by CCIWA or its licensors. All such material is protected by the Copyright Act 1968 (Cth) and other international copyright and intellectual property laws.

You may only use the materials and content for your own private non-commercial use. No part of the materials and content covered by copyright should be copied, reproduced, modified, distributed, transmitted, or republished in any form or by any means without the written permission of the CCIWA.

Privacy

CCIWA is committed to protecting your privacy and ensuring that your contact with CCIWA is a safe and rewarding experience. CCIWA has a privacy policy to manage privacy.  A copy of CCIWA’s privacy policy is available on our website.

By enrolling into a Training Course or attending an Event, you acknowledge that you have read and understood the CCIWA privacy policy and you agree with, and consent to, the practises described in that policy.

General

Changes to Terms and Conditions

From time to time, CCIWA may update these Terms and Conditions. The updated Terms and Conditions will apply to all Training Courses and Events from the time of posting on our website and onwards.

Severability

Any provision of, or the application of any provision of, these Terms and Conditions which is void, illegal or unenforceable in any jurisdiction does not affect the validity, legality or enforceability of that provision in any other jurisdiction or of the remaining provisions in that or other jurisdiction.

Governing Law

These Terms and Conditions are governed by the laws of Western Australia.  Each party irrevocably submits to the non-exclusive jurisdiction of the courts of Western Australia.

Your Terms and Conditions

If you supply your terms and conditions on any document at any time (including on consignment notes, purchase orders or other documents) your terms and conditions will be of no legal effect and will not constitute part of the agreement for the provision of the Training Course and/or Event, even if a representative of CCIWA signs a document that indicates that your terms and conditions apply.
